Terms of Use

These terms explain what you can expect from Kivo and what we ask of you when you use it to organize and play pickleball.

Accepting these terms

By creating a Kivo account or using our website, you agree to these terms. If you do not agree, please don't use Kivo.

Who can use Kivo

You need to be able to enter into a binding agreement in your country to hold an account, and you must be at least 13 years old. Younger players are welcome on court, but their account should be held and managed by a parent or guardian.

Your account

Keep your password to yourself and your email address up to date, and tell us promptly at support@kivo.ph if you think someone else is using your account. You are responsible for activity that happens under your account. Give us accurate information when you sign up — including a real name your fellow players will recognise.

Playing fair: community conduct

Kivo is for people who want to play. When you use it, please:

• treat other players with respect, on and off the court;
• turn up when you have joined a game, and withdraw early if your plans change;
• record results honestly, and don't manipulate ratings or rankings;
• don't harass, threaten or discriminate against anyone;
• don't misuse the service — no spam, scraping, security testing without permission, or attempts to break or overload Kivo.

Games created by players

Any Kivo player can create a game and invite others. The player who creates a game decides its details — time, place, format and who may join — and is responsible for organizing it. Kivo provides the tools; we don't run those games, vet the players, or guarantee that a game will go ahead as described.

Results, ratings and rankings

Ratings and rankings are calculated from the results players record. They are intended for friendly competition and matchmaking, not as an official standard, and they may change as we improve how they are calculated. We may adjust or remove results and rankings that appear inaccurate or manipulated.

Information you provide

You keep ownership of the content you add to Kivo. By adding it, you give us permission to host and display it so the service works — for example showing your name to the other players in a game. Don't upload anything you don't have the right to share. Our Privacy Policy explains how we handle personal information.

Courts, venues and other facilities

Kivo does not own, operate, book or inspect courts or venues unless we say so explicitly. Any arrangement with a venue, including bookings, fees and rules of entry, is between you and that venue.

Sport involves risk

Pickleball is a physical activity. You take part at your own risk and are responsible for deciding whether you are fit to play. Kivo is not responsible for injuries, losses or disputes arising from games you arrange or join, or from the conduct of other players.

Availability of the service

We work to keep Kivo running well, but we can't promise it will always be available or error-free. Features may change or be withdrawn as the product develops, and we may need to suspend the service for maintenance.

Our role, and limits on liability

Kivo is a tool for organizing games between players. To the fullest extent the law allows, Kivo is provided “as is”, and we are not liable for indirect or consequential losses, or for the acts of other players, venues or third parties. Nothing in these terms limits liability that cannot be limited by law.

Intellectual property

The Kivo name, logo, design and software belong to us and may not be copied or used without permission. These terms don't give you any rights to our branding.

Suspension and closing accounts

You can stop using Kivo at any time and ask us to close your account. We may suspend or close an account that breaks these terms, is used to harm other players, or puts the service at risk. Where it's reasonable to do so, we'll tell you why.

Changes to these terms

We may update these terms as Kivo develops. When we make a material change we'll update the date at the top of this page and, where appropriate, let you know by email. Continuing to use Kivo after a change means you accept the updated terms.

Governing law

The governing law and the courts that will handle any dispute will be confirmed on this page before Kivo opens to the public.
